Illustrating your answer with a case study of one International Criminal Court (ICC) case, critically assess the role of the ICC, and international criminal justice, in enabling the transition of states from conflict to post-conflict.

This question creates an opportunity for you to reflect on what you have learned by studying W821 and to carry out further research into the work of the ICC. The question asks you to critically evaluate the work of the ICC in achieving justice in states transitioning from conflict to post-conflict. In carrying out this task, the EMA question asks you to critically engage with a case study of a single ICC case which will illustrate your answer.

In order to answer this question well, you will need to demonstrate several aspects of knowledge and skills which you have gained whilst studying W821. These are listed under the heading ‘learning outcomes’. We strongly advise that you carefully read the learning outcomes before writing your EMA and make sure that you understand what is expected of you.

Your tutor will be able to discuss this with you should you require such assistance. Critical evaluation Firstly, you are asked to critically evaluate the contribution of the ICC to the achievement of post-conflict justice. This part of the question focuses on assessing your ability to form a critical opinion using arguments supported by evidence from your research.

You have learned about international criminal law and the ICC in Units 12 and 13. The knowledge and skills that you have gained from studying these units should be a good starting point for answering this EMA. However, please remember that as a part of this EMA you need to carry out independent research into primary and secondary sources of international law.

The strength of your answer relies on the depth of your research, the ability to present and assess your findings, as well as the quality of your critical evaluation. An ICC case Secondly, your answer should be constructed around a discussion of an exemplary case study of an ICC case.

In order to complete this part of your answer, you are required to carry out independent research into ICC case-law. Please note that the case study should be used in support of your critical evaluation. Engaging critically with a case and its surrounding context should allow you to develop and enhance your arguments by examining the practice of the ICC.

In your answer, you have to refer to a judgment in your chosen ICC case. Independent research Please remember that this EMA is research-focused and therefore, in order to answer this question effectively, you are expected to carry out independent research. You must refer to primary and secondary international law sources in your answer. In particular, the question asks you to engage with an ICC case in support of your critical evaluation. The research skills you developed through the study of the module should enable you to find and select appropriate sources and relevant examples for your answer. Please remember to clearly demonstrate your argument and to maintain the clarity of your argument throughout the essay.

Finally, be mindful of the word limit, the applicable academic writing conventions and the requirement to submit an EMA reflective diary. Learning outcomes The EMA tests the following learning outcomes: knowledge and understanding of international criminal law to identify, critically assess and correctly apply case-law from the ICC to critically evaluate legal debates and developments in relation to the work of the ICC
